These Terms apply to your use of the Site only. Actual accounting, bookkeeping, controller, and CFO services are governed by a separate client services agreement signed between you and Finsightic. In the event of any conflict, the client services agreement takes precedence.
Finsightic is a financial services consulting firm providing outsourced accounting, bookkeeping, controller oversight, and fractional CFO services to growing businesses. We operate at finsightic.com and can be reached at hello@finsightic.com.
Finsightic is not a licensed public accounting firm. We do not provide audit, attest, or compilation services. We do not prepare or file tax returns unless explicitly contracted to do so and only through qualified third-party CPA relationships. See Section 6 for full details.
You may use the Site for lawful purposes related to evaluating or engaging Finsightic's services, accessing our free tools and resources, and learning about accounting and finance topics we cover.

The client portal at apps.finsightic.com is a separate application governed by its own terms. Access is granted only to active Finsightic clients.
Finsightic provides free financial calculators and downloadable templates through the Site (the "Tools"). These include burn rate calculators, break-even analysis, SaaS metrics dashboards, payroll cost estimators, and others.
Important: All Tools are provided for informational and educational purposes only. Results generated by our Tools are estimates based solely on the inputs you provide. They do not account for your complete financial situation, applicable laws, industry-specific factors, or professional judgment. They are not a substitute for professional financial, accounting, tax, or legal advice.
By using our Tools, you acknowledge and agree that:
Accounting, bookkeeping, controller, fractional CFO, financial cleanup, and operational support services provided by Finsightic are subject to a separate written client services agreement. Nothing on this Site constitutes an offer to provide services, and no services commence until a signed agreement is in place and any required upfront fees have been received.
Services are delivered based on the scope defined in your client services agreement. Any changes to scope must be agreed upon in writing. We reserve the right to decline scope changes that fall outside our areas of expertise or create conflicts of interest.
Unless otherwise specified in your client services agreement, fees are billed monthly in advance. Overdue invoices may result in suspension of services. All fees are stated in US dollars. Finsightic's pricing is fixed and agreed upon before services begin - there are no surprise charges for work within agreed scope.
Ongoing services are provided on a month-to-month basis unless otherwise stated in your agreement. Either party may terminate with reasonable written notice as specified in the client services agreement. One-time projects (such as financial cleanup or operational support projects) are governed by the project scope and timeline in the signed agreement.
You agree to provide accurate, complete, and timely information required for us to perform our services. Finsightic is not responsible for errors, delays, or omissions resulting from inaccurate or incomplete information provided by you or your team. You remain responsible for reviewing all deliverables and for all financial decisions made on the basis of our work.
We work within accounting and financial platforms you use or that we recommend (e.g., QuickBooks Online, Xero, Gusto, Bill.com). Your use of those platforms is governed by their respective terms of service. We are not responsible for data loss, service interruptions, or pricing changes by third-party platforms.
Finsightic is not a Certified Public Accounting (CPA) firm and is not licensed to provide audit, attest, compilation, review, or assurance services. We do not issue audited or reviewed financial statements. We do not represent you before the IRS or state tax authorities. We do not prepare or file income tax returns unless separately contracted through a qualified CPA partner.
Our services are back-office consulting and financial operations support. If you require licensed accounting, audit, or tax services, we will coordinate with your CPA or refer you to a qualified partner.
Nothing we deliver - including financial statements, reports, analyses, or recommendations - should be construed as the output of a licensed public accounting firm.

All content on the Site - including text, graphics, logos, calculators, templates, tool code, and designs - is owned by or licensed to Finsightic and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
We grant you a limited, non-exclusive, non-transferable license to access and use the Site and its publicly available resources (including downloadable templates) for your own internal business purposes. This license does not include the right to resell or redistribute our tools or templates, or to use them in a way that competes with Finsightic's business.
Any information you submit through the Site (contact forms, calculator inputs, file uploads) remains yours. By submitting it, you grant us a limited license to use it solely to respond to your inquiry or deliver the requested services. We do not claim ownership of your business data.
Financial reports, models, and other work product created specifically for you under a client services agreement become your property upon full payment. Templates, methodologies, and tools we use to create those deliverables remain our intellectual property.
We understand that any financial or business information you share with us is sensitive. Finsightic treats all non-public information about your business as confidential and does not disclose it to third parties except as described in our Privacy Policy or as required by your client services agreement.
You agree to treat as confidential any non-public information about Finsightic's methods, pricing, processes, or team that you learn through our engagement.
Confidentiality obligations under these Terms survive termination of your use of the Site or any services engagement.
THE SITE AND ALL CONTENT, TOOLS, AND RESOURCES PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINSIGHTIC AND ITS PRINCIPALS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In all cases, Finsightic's total aggregate liability to you for any claims arising from your use of the Site shall not exceed one hundred US dollars ($100).
For claims arising from professional services provided under a client services agreement, liability is limited as stated in that agreement.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless Finsightic and its principals, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
We reserve the right to terminate or suspend your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, to us, or to third parties, or for any other reason at our sole discretion.
Upon termination, your right to use the Site ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections 6 (Not a licensed firm), 7 (No advice), 8 (Intellectual property), 9 (Confidentiality), 10 (Disclaimers), 11 (Limitation of liability), 12 (Indemnification), and 14 (Governing law).
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms or your use of the Site shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in New York County, New York, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any class action or representative proceeding.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
We may revise these Terms at any time by posting an updated version on this page. The "Last updated" date at the top will reflect when changes were made. For material changes, we may also notify active clients by email.
Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the Site.
